1.1. These General Terms and Conditions (GTC) apply to the use of the online mediation platform "Scubago" (hereinafter "platform"), operated by:

For Dive Centers, the framework conditions for using the referral platform described in Appendix 1 also apply.
1.2. The platform enables independent third-party providers (hereinafter "Dive Centers") to offer diving services (e.g., diving courses, packages, events, accommodations, etc.) to users of the platform. The display of such services on the platform does not constitute a recommendation by Scubago.
1.3. Scubago acts solely as a technical intermediary and does not become a contracting party to any services booked. Scubago is neither a tour operator within the meaning of the EU Package Travel Directive nor a provider of the mediated services and assumes no liability for their performance.
2.1. Scubago provides the platform through which users can view, and request services offered by Dive Centers. Scubago is not responsible for the proper performance, quality, or safety of such services on site.
2.2. To offer services on the platform, Dive Centers pay an annual usage fee to Scubago. Use of the platform is free of charge for users.
2.3. Scubago ensures the technical availability of the platform within the limits of technical and operational possibilities but does not guarantee uninterrupted availability.
2.4. Scubago is neither a tour operator within the meaning of the EU Package Travel Directive nor a provider of the mediated services and assumes no liability for their performance.
3.1. To request services from Dive Centers, the user must first register on the platform and accept these GTC. If the user does not agree to the GTC, they cannot use the platform. Registration requires providing a name, email address, and setting a password.
3.2. After submitting the registration, the user will receive a confirmation email. The registration process is completed once the confirmation link has been activated, and the user can then send requests via the platform.
3.3. A request may be sent directly to the Dive Center by clicking on the relevant service.
3.4. After a successful request, the user will receive a confirmation directly from the Dive Center containing all relevant service data, which constitutes the contractual basis.
3.5. The performance of services is subject exclusively to the Dive Center's general terms and conditions. Scubago has no influence on such terms and assumes no responsibility for their accuracy or validity.
The use of our platform and the conclusion of contracts are permitted only for individuals of legal age who have full legal capacity. Users under the age of 18 may use our services solely with the express consent of their legal guardians.
By registering and using the platform, the user confirms that they are at least 18 years old or that they have obtained the consent of their legal guardian.
If a reservation is made without the required consent, we reserve the right to cancel the contract. In such cases, the legal guardian shall be liable for any resulting damages and costs.
4.1. Scubago itself does not process payments between customers and Dive Centers.
4.2. Payment takes place directly between the customer and the Dive Center, either:
4.3. Scubago is not involved in the payment process and assumes no responsibility for payments, deadlines, or refunds.
5.1. Service content is provided exclusively by the Dive Centers.
5.2. Scubago accepts no responsibility for the accuracy, completeness, or timeliness of the content uploaded by the Dive Centers. Scubago expressly does not check this content.
6.1. Scubago shall not be liable for damages or claims arising in connection with the provision of the mediated services (e.g., diving accidents, non-performance, accommodation defects, etc.).
6.2. Scubago's liability is limited to intent and gross negligence. Liability for damages arising from injury to life, body, or health, as well as liability under mandatory provisions of the German Product Liability Act, remains unaffected.
6.3. In the case of slight negligence of material contractual obligations, liability is limited to foreseeable, typical damages.
7.1. Scubago is only obliged to properly mediate between user and Dive Center. Any warranty regarding proper performance or quality of the Dive Center's services is expressly excluded.
7.2. Any claims for defects or damages must be made directly against the respective Dive Center.
It is recommended to obtain suitable diving accident insurance, international health insurance, and, if applicable, travel cancellation insurance, as such coverage is not included in the mediated services unless explicitly offered by the Dive Center.
9.1. Scubago reserves the right to amend these GTC at any time with effect for the future. Users will be informed in due time and in an appropriate manner.
9.2. Users may object to the amended GTC within 14 days of notification. In such case, Scubago reserves the right to terminate the contractual relationship.
9.3. If the user does not object to the amended GTC within 14 days of receipt, the amendments and thus the new GTC are deemed accepted.
10.1. The user may terminate their relationship with Scubago at any time by deleting their account, either online or by contacting Scubago at info@scubago.com. The account will be deleted immediately or within two days of receipt of such notification. Account deletion does not affect any prior requests made to Dive Centers.
10.2. Scubago may terminate the relationship with the customer without cause by giving three months' notice. After expiry of the notice period, the account will be deleted, and no further requests can be made. Account deletion does not affect any prior requests made to Dive Centers.
10.3. Scubago may terminate the relationship with immediate effect if the customer has violated these GTC or used the platform unlawfully.
10.4. Scubago reserves the right to discontinue the platform at any time. Such discontinuation does not affect any prior requests made to Dive Centers.
Please note that Scubago is not a member of an alternative dispute resolution body and does not agree to use such a body. Scubago seeks to resolve issues directly through customer service (info@scubago.com) or via the Dive Center's contact person.
13.1. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
13.2. The place of jurisdiction for all disputes is, to the extent legally permissible, the registered office of SSI International GmbH. For consumers, jurisdiction is determined by their residence. However, consumers are also free to choose the registered office of SSI International GmbH as the place of jurisdiction.
13.3. Should individually provisions of these GTC be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
